(SACRAMENTO) — California said Monday that it will fight a judge’s ruling ordering the state to consider earlier parole for potentially thousands of sex offenders, such as those convicted of raping an unconscious person.
Gov. Jerry Brown’s administration will appeal the order by Sacramento County Superior Court Judge Allen Sumner, said Vicky Waters, spokeswoman for the Department of Corrections and Rehabilitation. The judge previously said in a tentative ruling that prison officials must rewrite part of the parole regulations in a ballot measure passed by voters in 2016.
No inmates will be released while the appeal is underway, Waters said. She said in a statement that the ruling “does not reflect the intent of California’s voters who approved Proposition 57 by a 2-to-1 margin.”

Everyone is screaming about Prop 57 letting out “violent” offenders…and the CDCR wants to fight a ruling that will force them to define “nonviolent” because they have no common sense? So let’s say someone, male or female engages willingly in oral sex while in prison with the same sex, or willingly commits sodomy… has to get on the registry…Is that violent? Has anyone watched Orange is the New Black? Is anyone screaming violence because the women appear to be engage in oral sex with one another? No. So what is this, homophobic? They hand out condoms in prison, but if you willingly participate in sodomy, you’re now considered violent and it’s a registerable sex offense?
After being sentenced to three years in prison for raping his wife my son was paroled and told by his PO that he would have to wear an ankle monitor for an additional three years .He had been on parole for two years thinking he would be off in one more year when he was called back in to his POs office and told he had eight more years on parole .He served his prison time as he should no problems!
I would like to know if non violent sex offenders serving time as of current, will be released if they have served their base term already? According to an appeal being filed againset the judges ruling, the cdcr will not release anyone during the appeal process, can they do that?
